If you are dependent on the help of others due to health impairments, under certain circumstances you may be entitled to care assistance under the Twelfth Book of the German Social Code (SGB XII) in addition to your care insurance entitlements. The reason for the need may be physical, cognitive or mental impairments or health-related burdens or requirements that cannot be compensated for and managed independently. The Medical Service (MD), which is commissioned by your care insurance company, determines whether and to what extent care is required. You can obtain further information on the assessment procedure from your long-term care insurance provider. The Medical Service (MD) determines your need for long-term care. Your care insurance fund is then responsible for covering the care costs. However, the costs will only be covered by the long-term care insurance up to certain maximum limits, depending on the type of benefit. If you are unable to cover the remaining uncovered costs, social welfare benefits (SGB XII) - such as care assistance - may be available, taking into account the findings of the MD.
If you do not have long-term care insurance and therefore do not receive an expert opinion from the MD and no classification into a care degree from the long-term care insurance fund, the social welfare provider can commission a corresponding assessment. You will only receive care assistance if your income and assets (or those of your spouse or partner) are insufficient. Dependent relatives are called upon if their annual gross income is more than EUR 100,000.00, see also the Act on Relief for Dependent Relatives in Social Welfare and Integration Assistance (so-called Relatives Relief Act).
