Building application procedure
Everything you need to know about the building application and the building permit
In addition to the construction of buildings, the term "construction measures" also includes the change of use, alteration and demolition of buildings.
Construction measures are subject to approval in accordance with Section 59 of the Lower Saxony Building Code (NBauO) or at least subject to notification in accordance with Section 62 of the NBauO. This means that a building permit must be obtained by the building owner before the start of the building project, or the planned building measure must be notified to the Bau-Bürger-Büro.
If necessary, it may also be unnecessary to submit a building application because your building project is a so-called permit-free building project according to section 62 NBauO or a procedure-free building project according to section 60 NBauO.
Insofar as you wish to implement a construction measure on your property that requires a permit, you must submit a building application in order to obtain the required building permit.
The requirements for this are:
Preparation of the building application by a so-called design drafter.
The builder must use a qualified design consultant (architect, registered design consultant, etc.) in accordance with Section 53 NBauO, otherwise the building application will be formally rejected.
Documents
Depending on the type of building project, the following documents are required for the building application:
- Building application form
- Building description
- Site plan
- Floor plan drawings
- Sectional drawings
- elevation drawings
- Calculations of the number of floor areas, the number of storeys, the gross cubic capacity
- Proof of parking spaces
- Proof of stability
- Survey form for statistics
Please note that the above-mentioned documents for the submission of the building application only represent the standard case. Depending on the type and scope of the building project, additional documents may be required.
The building application must be submitted at least in duplicate and must be signed by the design author and the building owner. The formal requirements for the building permit procedure are regulated in the Building Documents Ordinance.
Fees
The building permit is subject to a fee. The fees are based on the building fee regulations and depend on a number of factors (e.g. value of the building shell, type of approval procedure, etc.).

Further permits
If the construction project involves the discharge of wastewater or rainwater, a drainage permit is usually required. Specialist information can be obtained from the Land Drainage Department of the Wolfsburger Entwässerungsbetriebe (telephone: 05361 28-1250).
In the case of building projects which are difficult to assess or which are not within the scope of a development plan, or if you wish to have legal certainty, it is advisable to submit a preliminary building inquiry (Section 73 NBauO). You can also submit this before you purchase a property.
The preliminary building application should contain the following information:
- Use application form according to section 73 NBauO.
- Exact designation of the building plot; site plan or excerpt from the real estate cadastre
- Location of the building project on the plot
- Brief description of the project
The more precise the information, the more precise the preliminary building permit can be. Anyone can submit a preliminary building application; it is not necessary to use the services of a design consultant. The preliminary building permit is subject to a fee.
Not every building project requires a building permit. However, the fact that no building permit is required does not mean that everyone can build as they wish. Even building projects that do not require a permit must not violate public building law.
For example, more and more builders believe that buildings without foundations (e.g. a carport, a garden shed) can be erected without a building permit or without notification in accordance with section 62 of the building code.
