Change of the surname of the child

The registry office is responsible for the following name changes. In all other cases, this is an official name change. If the parents decide on a married name after the child has reached the age of five, the married name only extends to the child's birth name if the child agrees to the name. Children who have not yet reached the age of five automatically adopt the married name of their parents.

The choice of name is irrevocable.

Name change in the case of joint custody: options and conditions in the context of the child's fifth birthday

If joint custody of the parents is only established when the child already has a name, the child's name may be changed within three months of the establishment of joint custody. If the child has already reached the age of five, the designation is only effective if the child agrees to the designation.

Name change with sole parental custody: options and conditions for the child's name

If the parents do not have a married name and only one parent has parental custody, the child is given the name that this parent had at the time of the child's birth.
The parent who has sole parental custody of an unmarried child may give the child the name of the other parent by declaration to the registry office. The granting of the name requires the consent of the other parent and, if the child has reached the age of five, also the consent of the child.

Name change due to shared household: options and conditions for an unmarried child

The parent who has parental custody of an unmarried child, either alone or jointly with the other parent, and their spouse who is not a parent of the child, may give their married name to the child they have taken into their joint household by making a declaration to the registry office. They may also prefix or append this name to the name used by the child at the time of the declaration. The declarations require the consent of the other parent if he or she has joint parental custody with the parent granting the name or if the child bears his or her name. If the child has reached the age of five, the child's consent is also required.

The determination of the name is irrevocable.

Fees

The fee for a name declaration is 25.00 euros.
If you also need a new birth certificate, this costs an additional 10.00 euros. (only possible if the child was also born in Wolfsburg).
