  • Impact regulation

    The impact regulation is used to prevent, reduce and/or compensate for significant impairments to nature and the landscape, which can occur during construction projects, for example. According to the German Federal Nature Conservation Act (BNatSchG), an impact is deemed to have occurred if the performance and functionality of the ecosystem or the landscape can be significantly impaired by a change in the shape or use of land or the groundwater level associated with the living soil layer (Section 14 BNatSchG).

    Private construction projects can also trigger the intervention requirement.

    The principle of the impact regulation under nature conservation law is the avoidance of avoidable impairments. Where there are no reasonable alternatives and impairments to nature and the landscape are unavoidable, these must be compensated or replaced by the polluter through nature conservation and landscape management measures (Section 15 BNatSchG).

    Unavoidable impairments must be compensated for by the polluter through compensatory or replacement measures. This means that the functions of the ecosystem or the landscape that have been impaired or destroyed by the intervention must be restored in a similar or equivalent manner. If compensatory and replacement measures are demonstrably not feasible, it is possible in individual cases to compensate for the impact with a compensation payment. Examples of compensatory and replacement measures (compensation measures) include the planting of new trees or hedges, the creation of new orchards and the (partial) unsealing of areas. The nature conservation authority of the city of Wolfsburg is obliged to record the compensation measures and the areas used for them in a compensation register (Section 17 (6) BNatSchG and Section 7 NNatSchG).
