Building encumbrances

  • General information

    Building encumbrances are obligations entered in the register of building encumbrances on one plot of land for the benefit of another plot of land or a construction measure on another plot of land. A register of building encumbrances is kept which is kept by the Urban Planning and Building Consultancy is available for inspection.

  • Requirements

    Inspection of the register of building encumbrances:

    A justified interest in inspecting the register of building encumbrances must be proven - this is the case, for example, in connection with the purchase or sale of real estate or in connection with financing matters.

  • Required documents

    • Written request (form: Request for information/submission of a copy of the register of building encumbrances)

    • New extract from the land register of the property to be encumbered (available from the land registry, Wolfsburg district court)
    • Site plan with entry of the building encumbrance (land registry office, architect)
    • Addresses of the owners of the property to be encumbered
    • Addresses of the owners of the property to be benefited from

  • Fees

    Inspection of the building encumbrance directory:

    An excerpt from the register of building encumbrances currently costs 30.00 euros per parcel.

    Registration of a building encumbrance:

    Between 60.00 to 1620.00 euros (graduated according to administrative expense and value). These fees are charged to the owners of the property to be encumbered or the costs are assumed.

  • Special features

    The most important types of building encumbrances:

    Unification building enc umbrance according to § 2 Para. 12 Nds. building code
    Effect: 2 or more plots of land are united to form one building plot with the result that the building regulations are generally applicable to the entire building plot.

    Access road encumbrance in accordance with § 4 Para. 2 Nds. building regulations
    Effect: The area of a property is secured as a necessary access route to another property.

    Attachment enc umbrance according to § 5 para. 5 Nds. building regulations
    Effect: Obligation, to the appropriate cultivation at a border building, if is built.

    Distance building enc umbrance according to § 6 para. 2 Nds.building regulations
    Effect: Obligation to maintain an additional boundary distance with future structural facilities.

    Parking space encumbrance according to § 47 para. 4 Nds. building code
    Effect: Secures necessary parking spaces in favor of a nearby property.
